Member Agreement

This Member Agreement applies to all applicants and members participating in Apex Collective activities. By applying for membership and attending events, you acknowledge that you have read, understood, and agree to follow this agreement.

Guest attendance is event-specific and only applies when explicitly permitted by organizers.

This document complements, and does not replace, the Terms of Service and Privacy Policy.

1. Purpose And Community Standards

  • Apex Collective is a private membership community built around safe, respectful, and enthusiast-focused driving culture.
  • Membership is a privilege, not a right. The club may accept, deny, suspend, or remove membership at its discretion to protect member safety, reputation, and community quality.

2. Eligibility And Membership Expectations

  • Applicants and members must be at least 18 years old (the age of majority in Ontario) unless expressly approved otherwise in writing by Apex Collective.
  • Members must provide accurate application details, maintain valid driver licensing, and operate legally insured vehicles where required by law.
  • Members are expected to remain active, communicate respectfully, and represent the club positively in public and online spaces.
  • Repeated no-shows, chronic disruptive behavior, or dishonest information may result in suspension or removal.

3. Code Of Conduct

  • Treat every member, organizer, venue contact, and member of the public with respect. Harassment, discrimination, intimidation, and threats are prohibited.
  • No reckless driving, street racing, dangerous overtakes, road rage, or behavior that creates avoidable risk.
  • No ego-driven conduct: no clout-chasing that compromises safety, no deliberate disruption of routes, and no hostile competition among members.
  • Members must follow organizer instructions during meets, convoying, regroup points, and emergency situations.

4. Driving Safety And Legal Compliance

  • Members are solely responsible for following all traffic laws and local regulations at all times.
  • Zero tolerance for impaired driving at club activities. Anyone suspected of impairment may be immediately removed from an event.
  • Vehicles must be mechanically safe for participation. Organizers may deny participation to vehicles that present a safety concern.
  • Seatbelts are mandatory for all occupants during movement unless local law explicitly provides an exception.

5. Events, Guests, And Operations

  • Certain events may be limited-capacity, invite-only, or require pre-registration and waivers.
  • Some events are strictly members-only. Guests are only allowed when an event is explicitly marked guest-permitted by organizers.
  • Where guests are permitted, the inviting member is responsible for guest conduct and compliance with safety and behavior standards.
  • Event details, routes, and logistics shared in member channels may be confidential and should not be publicly redistributed without permission.

6. Content, Photos, And Media Use

  • Club events may be photographed or recorded. By participating, members acknowledge that media may be used by Apex Collective for community and promotional purposes.
  • Photos and videos of your vehicle, including visible license plates, may be uploaded to Apex Collective channels (for example: website galleries, social media, and member channels).
  • Members must obtain permission before using Apex branding, logos, or official event media for commercial projects.
  • Members should avoid posting identifying details that put other members at risk (for example: private addresses, plate details, live location without consent).

7. Privacy And Data Handling

  • Membership and application data are handled according to the Privacy Policy.
  • Members must not scrape, export, or share member data or private community content without explicit authorization.

8. Enforcement, Suspension, And Termination

  • Violations may result in warning, temporary suspension, event restriction, or permanent removal.
  • Serious safety or conduct breaches may lead to immediate removal without prior warning.
  • Where appropriate, the club may review context and member response before final action.

9. Liability And Assumption Of Risk

  • Automotive events and group drives carry inherent risk. Participation is voluntary and at your own risk.
  • Apex Collective, its organizers, and volunteers are not responsible for personal injury, vehicle damage, theft, fines, citations, or indirect losses arising from participation, except where liability cannot be excluded by law.
  • Members are responsible for their own insurance, vehicle condition, and legal compliance.

10. Policy Updates

  • This agreement may be updated from time to time. Material changes may be communicated through official club channels.
  • Continued participation after updates indicates acceptance of the current agreement.

11. Governing Law And Jurisdiction

  • This agreement is governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
  • You agree that disputes relating to membership, participation, or enforcement will be brought before the courts of Ontario, unless applicable law requires otherwise.
